14 killed in Madagascar flooding

No fewer than 14 people died in flooding in the Madagascan capital Antananarivo after a night of torrential rain that caused dams to break, rescue services said. About 24 000 people were driven out of their homes in the floods and several neighbourhoods were being evacuated in the Indian Ocean island nation, the country's emergency management bureau said. "Due to the emergency, we call on all schools, churches, town halls, covered gymnasiums and those of good will to facilitate the sheltering of victims," a statement from the bureau said. Prime Minister Jean Ravelonarivo visited affected areas early on Friday and speedboats were being used to evacuate hard-hit areas. Three rivers flow in the area of the capital and a number of dams broke, causing around 50 houses to collapse, the statement said. Electricity was also cut to parts of the capital, with tree trunks carried away in the flooding affecting the operation of a power plant.

Mbu AIG DENIES ORDER TO SHOOT CIVILIAN

Former Nigeria's Rivers State Commissioner of Police and current Assistant-Inspector General of Police in charge of Zone 2, Lagos, has said he was misquoted by reports that he ordered policemen to kill 20 civilians for every officer killed in the coming general elections. AIG Mbu in a statement signed by the Zonal Police Public Relations Officer, Olugbemiga Adeoye, explained that he only “advised his policemen not to be cowardly but to be guided by Force Order 237 on the use of their firearms.” According to him, the firearms are not only meant to defend themselves but also others “including fellow police officers when their lives are in danger.” The AIG, who said he was quoted out of context, believes that reports on the issue have been fraught with political undertone. He said such reports were geared towards portraying him in a bad light and as an officer who does not uphold the rule of law. The statement said, “Although policemen are not to be seen with firearms within a specific radius of the polling area, quick response squads will be created to respond to distress calls. “There is no society in the world where policemen will be killed by hoodlums and the perpetrators will be allowed to escape justice.” He said he was also quoted out of context on the alleged order to arrest governors at polling units. “What he (Mbu) said was that no highly placed individuals in the society who have police escorts and other forms of personal guards will be allowed within the voting area accompanied by such retinue of escorts,” the statement said.

The All Progressives Congress (APC) caucus in the Senate
has warned of an alleged plan by the executive to sack the
Chairman of Independent National Electoral Commission
(INEC), Professor Attahiru Jega.
Speaking to journalists after plenary, the Senate Minority
leader, Senator George Akume, said the APC was aware of
the plan to ask the INEC chairman to proceed on pre-
retirement leave.
Professor Jega’s tenure as INEC chairman is expected to
end in June this year.
Senator Akume said the APC would resist any plan to
remove Professor Jega at this critical time.
He further stressed that any plan to remove the INEC
chairman is capable of sabotaging the forth coming general
elections.
A former Oyo State Governor, Mr Victor Olunloyo had called
for the immediate resignation of INEC chairman, Prof.
Attahiru Jega.
In an exclusive interview with Channels Television in Ibadan,
the Oyo State capital, Mr. Olunloyo opined that Jega’s
resignation would pave way for better reforms, as several
attempts have been made to discredit him and his office.
He urged the electoral body to desist from using the Ekiti
2014 governorship poll as a template for credible elections
in Nigeria, insisting that the election was tainted with series
of malpractices.
The elder statesman further stressed the need to conduct
credible elections starting with sincerity in PVC distribution,
and holding politicians responsible for their mistakes.
Meanwhile, the Senator representing Oyo South Senatorial
District, Sen. Olufemi Lanleyin, in a swift reaction negated
Olunloyo’s submission, describing Jega as a credible
professional who must be encouraged to conduct a credible
poll.

Early life and education
Folorunsho was born in 1951 to the family of Chief L. A.
Ogbara in Ikorodu, Lagos State . At age seven, she traveled
to the United Kingdom to begin a four-year primary
education at Dinorben School for Girls in Hafodunos Hall in
Llangernyw, Wales . After returning to Nigeria, she attended
Muslim High School Sagamu Ogun State, Nigeria.
Afterwards, she returned abroad for her secretarial studies
at Pitman's Central College, London. She also studied
fashion design at the American College, London and the
Central School of Fashion. [6]
Career
Folorunsho started her career in 1974 as an executive
secretary at Sijuade Enterprises, Lagos, Nigeria. She moved
on to the former First National Bank of Chicago, now
FinBank now acquired by FCMB (First City Monument
Bank), [7] where she worked for some years before
establishing a tailoring company called Supreme Stitches. It
rose to prominence and fame within a few years, and as
Rose of Sharon House of Fashion, became a household
name. [8] As national president and lifelong trustee of the
Fashion Designers Association of Nigeria (FADAN), she left
an indelible mark, promoting Nigerian culture through
fashion and style. [3][9]
In May 1993, Folorunsho applied for the allocation of an oil
prospecting license (OPL). [10] The license to explore for oil
on a 617,000-acre block—now referred to as OPL 216—was
granted to Alakija's company, Famfa Limited. The block is
located approximately 220 miles south east of Lagos and 70
miles offshore of Nigeria in the Agbami Field of the central
Niger Delta. In September 1996, she entered into a joint
venture agreement with Star Deep Water Petroleum Limited
(a wholly owned subsidiary of Texaco) and appointed the
company as a technical adviser for the exploration of the
license, transferring 40 percent of her 100 percent stake to
Star Deep. [11][12] Subsequently, Star Deep sold off 8
percent of its stake in OPL 216 to Petrobras , a Brazilian
company.
As of 2014, she is listed as the 96th most powerful woman
in the world by Forbes. [5]
Philanthropic interests
Folorunsho has a foundation called the Rose of Sharon
Foundation that helps widows and orphans by empowering
them through scholarships and business grants. [13][14][15]

On 1 July 2013, the federal government of Nigeria
inaugurated the National Heritage Council and Endowment
for the Arts and appointed Alakija as vice-chairman of the
body. While inaugurating the council, Nigeria 's Minister of
Tourism, Culture and National Orientation, Edem Duke, said
Nigeria had identified 100 new heritage sites, which "are
unique and uncommon assets that we intend to preserve
and promote." He charged the council, which is headed by
Igho Sanomi, to "ensure the protection and conservation of
places and objects of heritage significance and the
registration of such places and objects." [17]
Personal life
Folorunsho married a lawyer, Modupe Alakija in November
1976. They reside in Lagos, Nigeria with their four sons. [6]

Four Killed In Oshodi Clash

people have been killed following a clash between rival
members of the National Union of Road Transport Workers
at the Mosafejo area of Oshodi in Lagos state.
The fracas which reportedly started on Tuesday evening
lasted till Wednesday after the intervention of security
agents who are still keeping watch over the area to avoid
further breakdown of law and order.
The violence also led to the destruction of many property,
including about 27 vehicles, 15 of which were completely
burnt. Several shops located at the Mosafejo motor park
were also razed.
It was gathered that trouble started after the rival gangs of
the union disagreed over an order given to them by the
police to stop the smoking of Indian hemp in the area.

Marijuana is now legal in Washington, DC.

DC voters in November approved a ballot initiative that
allows adults 21 and older to possess up to two ounces of
marijuana, grow up to six plants, and gift up to one ounce
of pot to other adults 21 and older. The measure, which
took effect Thursday, doesn't legalize sales, so anyone who
tries to make a profit off marijuana could still get locked
up. Smoking in public remains banned.
Marijuana will still be illegal on federal property, such as
parks and monuments, since it remains prohibited at the
federal level. It also remains banned in federally subsidized
public housing. DC police likely won't enforce these bans,
but federal police agencies might.
DC is unique, because its marijuana legalization measure
doesn't allow pot stores.
Marijuana is currently legal in Colorado, Washington state,
and Alaska, and it will be legalized in Oregon later this
year. All four states already or will eventually allow sales at
retail outlets.

Although possessing, gifting, and growing marijuana will be
legal in DC, buying pot will still be prohibited. While that
may be a buzzkill to DC stoners, drug policy experts are
excited to see how it plays out.
"One of the things we've been working very hard in
marijuana legalization discussions is to get people to
recognize there are at least 10 different fundamental
architectures for legalizing marijuana," Jon Caulkins, a drug
policy expert at Carnegie Mellon University, said.
In a January report on marijuana legalization for the
Vermont legislature , Caulkins and other experts outlined 12
alternatives to the current model of prohibition. Among the
options: continued prohibition with decreased penalties,
legalization with commercial sales, letting adults grow
marijuana, allow distribution only within small private
clubs, and have the state government operate the supply
chain and sell pot.

Military Set To Capture Shekau Alive

onslaught against the insurgents in the northeast gathers
momentum, there are indications that the Nigerian military
is directing efforts towards capturing the leader of the
Boko Haram sect alive.
To this end, troops are said to have been placed on high
alert to apprehend Abubakar Shekau, who is reported to be
desperately trying to escape from the area.
The military is believed to have resolved to take Shekau
alive to put an end to insinuations of the invincibility of the
militant leader, especially against past announcements of
his demise by the military, which turned out not to have
been accurate.
In August 2013, the then spokesperson of the Force, Lt. Col.
Sagir Musa released a statement which said “intelligence
report available to the Joint Task Force Operation RESTORE
ORDER revealed that Abubakar Shekau, the most dreaded
and wanted Boko Haram Terrorists leader may have died”.
He added that Shekau “died of gunshot wound received in
an encounter with the JTF troops in one of their camps at
Sambisa Forest on 30 June 2013. Shekau was mortally
wounded in the encounter and was sneaked into Amitchide
– a border community in Cameroun for treatment which he
never recovered. It is greatly believed that Shekau might
have died between 25 July to 3 August, 2013”.
However, Shekau re-surfaced in a video a in September
2013.
The current efforts at routing the insurgents, whose
activities have claimed the lives of thousands of Nigerians,
is reportedly being led by top generals riding on the high
troops morale that has been boosted with the delivery of
sophisticated armaments.

Kidnappers Of U.S. Female Missionary Demand 50 Million Naira

Rev. Phyllis Sortor was abducted from the Hope Academy
compound around 10:00am on Monday in Kogi State.
The Free Methodist Church in a post on their website
confirmed the attack.
“Early this morning we received a report that Rev. Phyllis
Sortor, our missionary in Nigeria, was abducted from the
Hope Academy compound in Emiworo, Kogi State, Nigeria
by several persons,” the church said.
The Kogi State police command confirmed the
kidnapping and said five gunmen, two of them
wearing masks, scaled the fence bordering the
missionary’s compound, fired sporadically and
made off with her.
The missionary apart from running an NGO, is
said to have secured a grazing land specifically
for herdsmen in a move aimed at discouraging
clashes between herdsmen and farmers.
U.S radio station, NBC station King5 reported that
Rev. Sortor is an alumna of Seattle Pacific
University.
Her stepson, Richard Sortor, told King5 at a
prayer service at SPU on Monday night: “She
believes in God, she’s doing God’s work.” He said
the news was “surreal, just surreal, I can’t believe
this.”
Rev. Phyllis Sortor has been working there for
about 10 years.
In one of Sortor’s latest updates online there was
no sign of distress. She came across upbeat,
writing: “Just a little note to share the joy with
you regarding the (long-awaited) opening of our
brand-new (International Child Care Ministries)
school in Enugu!”
A Bishop of the Free Methodist World Missions, David
Kendall, in a statement on the Church’s website on Monday
called for prayer for Rev. Sortor.
“The U.S. Embassy has been notified, and the State
Department and the FBI are working with local authorities
to find and rescue her. We are calling on the U.S. church to
join together in prayer for Phyllis’ safety and speedy
release,” the statement read.

The Nigerian securities industry and the 2015 national elections

The Investments and Securities Act, ISA, 2007 is the primary
law for the securities industry which law provides the
framework for the regulation of the Nigerian capital market by
the Securities and Exchange Commission, SEC. The Act sets
out to ensure the protection of investors and the maintenance
of fair, efficient and transparent market.
The Investments and Securities Tribunal, IST, is the
specialized tribunal created by the Act for specified capital
market matters. However, SEC is an agency of the Federal
Government and the Constitution has granted exclusive
jurisdiction to the Federal High Court when the Federal
Government or any of its agency is being challenged over any
executive or administrative action it took.
The IST has the distinct character that judgement should be
given within 90 days of the commencement of the hearing of a
matter before it. The Court of Appeal has recommended that
there should be a constitutional amendment to qualify the
jurisdiction of the Federal High Court such that matters vested
in a specialized tribunal or court can be determined before the
specialized tribunal or court notwithstanding the parties before
the specialized tribunal or court. We should put this
constitution amendment in place such that we can take full
advantage of the capacity of the IST.
A committee was set up by the Federal Ministry of Finance in
2010 to carry out a review of ISA 2007. The Committee invited
contributions from the public but it was not allowed to
complete its work. One of the major concerns of investors is
the procedure for the resolution of disputes between capital
market operators and their clients.
The 1999 version of the ISA allowed the IST to adjudicate on
matters relating to disputes between capital market operators
and their clients. However, the 2007 version of the ISA
requires clients of capital market operators to take their
complaints first to the Nigerian Stock Exchange, NSE, and
SEC and the matter could then be referred to the IST as an
appeal of a decision of SEC.
Regrettably, there is insufficient understanding that regulation
by SEC is a legitimate quasi-judicial procedure for prompt
dispute resolution at minimal cost. Some parties seek to
invalidate the dispute resolution process before SEC by
claiming on appeal that SEC has acted as investigator,
prosecutor and judge.
I believe that ISA 2007 should be amended to allow for capital
market operators/clients disputes to be taken directly to the
IST. A new committee should be put in place to review ISA
2007 and in particular the section on corporate responsibility
of public companies to include provisions for the protection of
investors/shareholders in companies. When a company listed
on the NSE fails, SEC and NSE have a primary responsibility
and not the Corporate Affairs Commission. The performance of
any company is entirely in the hands of the company’s
directors.
Directors have a duty of care and skill under Section 282(1) of
the Companies and Allied Matters Act (CAMA) and action can
be taken against directors for negligence and breach of duty
under Section 282(2) of CAMA. Shareholders cannot readily
obtain information on the directors’ acts of negligence and
breach of duty. A revised ISA 2007 should make it possible for
SEC to order an inquiry into a company quoted on the NSE
over and above the provisions of CAMA.

MAIDUGURI—THE Boko Haram sect has given reasons for its
weekend attacks, which led to the killing of about 162 people
in Kano State, saying it was to avenge the persecution of its
members.
Spokesman of the group, Abul Qaqa, made this known in a
telephone interview with newsmen in Maiduguri, yesterday.
Claiming responsibility for the attacks and multiple bombings
on police stations, State Security Services, SSS, and passport
office buildings in Kano metropolis, Qaga said: “Last night’s
(Friday) attacks and bombings of Kano city followed our
warnings in the second week of December, 2011.”
‘We warned Kano stakeholders’
Besides, Qaqa also referred reporters to an e-mail message in
which Imam Muhammad
Abubakar Shekau, Spiritual Head of the sect, threatened that:
“Unless urgent steps are taken, the group will launch endless
and violent attacks on Kano and its environs because of
arbitrary arrest and persecution of his members.”
Vanguard learnt that in the said e-mail, Shekau said the group
had written an open letter to the people of Kano, including the
Emir of Kano, Alhaji Ado Bayero; Governor Musa Kwankwaso,
Alhaji Aminu Dantata and Khalifa Sheikh Isiaka Rabiu on
recent happenings in the ancient city.

Shekau revealed that but for the intervention of some
prominent scholars in Kano, his group would have made the
city ungovernable a long time ago.
Alleges persecution
Qaqa said: “The message here is that everybody knows that a
lot of our people were killed in Kano State, especially in Wudil
town. We had perfected plans to take revenge but some
notable scholars intervened by pleading with us.
“They also assured that our members would nevear be
persecuted again and we took them by their words.
Unfortunately, however, about five months ago, security
agencies began trailing and arresting our members who are
carrying out their legitimate businesses, alleging that they are
all thieves and armed robbers.
“Again, we perfected plans to attack the city of Kano but the
scholars pleaded that we should not. They advised that we
should write a formal letter of complaint to some notable
people. We agreed and sent letters to the Emir of Kano,
Wamban Kano, Dan Masanin Kano and the governor of Kano
State.
“We also posted the open letter on the internet, but nothing
was done to stop the persecution of our members.
“Recently, security agencies launched a fresh onslaught on
some of our members in Kano city in which even women and
children were not spared. Many houses were raided and a
pregnant woman was manhandled.
‘We respected Kano’
“Some of our members were tortured with electric shock. All
these things happened in Kano, a city that we hold in high
esteem.
“We have varied opinions about Kano, including the option of
launching endless campaign of violence, but the scholars that
have been talking to us are still persuading us to tarry a
while.
“We are compelled to write this open letter so that the world
will know what is happening.”

General Muhammadu Buhari, rtd, yesterday eulogised the
Second Republic President, Alhaji Shehu Shagari as a
committed patriot and outstanding leader on his 90th birthday
today.
Jonathan, who is the presidential candidate of the Peoples
Democratic Party, PDP, in the forthcoming general elections
said that the present administration would continue to count
on the former President’s support and solidarity.
Also, Buhari, who is the opposition All Progressives Congress
presidential candidate congratulated Shagari, pointing out that
though his government toppled him (in a military coup in
1983), the nonagenarian has always shown some civility
towards him.
Buhari described Shagari as the “Grand Old Man of Nigerian
politics.”
President Jonathan in message prayed ‘’that Almighty Allah
will continue to bless the former President with good health
and long life,’’ saying, “It is with profound joy that I write on
behalf of my family, the Government and people of Nigeria,

General Buhari also, eulogised Shagari’s contributions to
national development since the colonial days saying that they
were enormous.
The message personally signed by General Buhari read,
“Although I am physically unable to be present as I am abroad
on previously arranged assignments, I wish to send my good
wishes to former President Shehu Shagari on his 90th
birthday.
“Alhaji Shehu Shagari is now the Grand Old Man of Nigerian
politics, having been in the frame of public affairs since the
colonial days.”
